EVENT TERMS

EVENT CHECK IN

The Platform will begin checking in vendors at 8:15AM for event set up. Vendors must be checked in by 9:00AM  Vendors must have their booth set up and vehicle(s) moved to designated vendor parking before 9:30PM. 

TEAR DOWN

Vendors must be set up for the full duration of the event. Early break down may result in Vendor being excluded from future events.

INFORMATION & NOTIFICATIONS

All information and notifications will come from Mandy Brasher via email (mandy@platformlongview.com) and will be sent to the email address entered on this form.

Information will also be posted in our vendor group.

CANCELATIONS

If Vendor needs to cancel, they must notify The Platform by email at mandy@platformlongview.com

If cancellation notification is received more than 45 days before the Event, Vendor will receive a full refund minus the 3% application processing fee.

If Vendor cancels within 44 days of the Event, they will receive a 50% refund minus the 3% application processing fee.

Any cancellations within 21 days of the event will not receive a refund. By cancelling, Vendor forfeits their spot at the event.

If a cancellation of the Event by The Platform is necessary due to unforeseen circumstances, such as weather or acts of a third party, or other circumstances which may compromise the safety of Event participants, then the Event will be rescheduled and there will be no refunds to Vendor.

EVENT TERMS & CONDITIONS

I understand, The Platform will limit vendors with the same type items to make each more as profitable as possible for each vendor.

Vendor booths are filled on a first come first serve basis. To ensure consistency across the board no spots can be held without payment.

Vendor Locations will be assigned by The Platform.

Vendors’ children should either be left at home or must stay in your vendor booth unless accompanied by an adult.

The Platform is a family environment and will restrict the following items: Inappropriate for children, including bad language or pornography, live animals, Low-quality items that have no collector or decorator interest, Unwanted household items, drug paraphernalia, items containing alcohol, items containing flammable liquids, tobacco products, firearms, ammunition, fireworks or explosives, large gas/electric powered appliances (stoves, washers, dryers, etc.), Hazardous, dangerous, or endangered materials. The Platform reserves the right to request removal any items it deem inappropriate.

Vendors are are responsible for bringing fixtures and decoration to define their space.

Vendors agree to review and abide by the Safety Plan provided  and posted on the website.

COTTAGE BAKERS

Anyone offering any type of food must contact the city obtain approval from the environmental health department to vend. The city ensures proper labeling of items and ensures any samples given are handled/labeled correctly. Bring a copy of their notification confirmation with you.

Cottage bakers, must be physically present to hand over items to the client. While the front end can handle the sale on their behalf, the creator must be present for the actual transaction. It's important to note that anyone without the proper license attempting to drop off food and leave it is considered wholesaling, which cottage bakers are not allowed to do per the Texas regulations. Unlike brick-and-mortar establishments, food trucks, caterers, etc., who have specific licenses.

 

Cottage bakers cannot engage in wholesaling; they must sell directly to the end consumer.

The producer of the food must directly sell to the consumer, and employees, in the traditional sense, must be paid at least minimum wage, with employers being responsible for their actions within the scope of employment, including withholding payroll taxes, etc.

FOOD TRUCKS

Mobile food units must be permitted by the City of Longview Environmental Health Division. Please see the Information About Becoming a Mobile Food Unit page.

Bring a copy of all your permits and documentation required by the City of Longview, Gregg County and the State of Texas

Vendors agree to read and abide by all directives, regulations, and Event rules provided to you, including those sent via email to the email address provided on your Application. The Platform reserves the right to decline, prohibit, or expel any Vendor exhibit, or prevent any activity, displays, product, or conduct, which is out of keeping with the character of the Event or endangers the venue, any attendee, or other vendors.

Vendor and its agents, employees, personnel, and/or independent contractors who participate in the Event agree to be bound by this Agreement and shall comply with its terms and all Event rules, regulations, and directives as may be expressed to Vendor by The Platform in any way at any time. The terms of this Agreement, including any limitations and waivers, inures to the benefit of The Platform and its affiliates and Event co-producers and sponsors.

The validity, interpretation, construction, and enforcement of this Agreement will be governed and controlled by the laws of the State of Texas, without regard to its choice of law principles. Any dispute arising out of or related to this Agreement must be brought in federal or state court in Gregg County and the parties hereby consent to the exclusive jurisdiction and the venue of such forum. The prevailing party in any such action shall be entitled to receive from the other its costs and expenses (including reasonable attorneys fees) in addition to any other relief it may be entitled to.

When you enter an event at The Platform. you enter an area where photography, audio, and video recording may occur. By entering the event premises, you consent to interview(s), photography, audio recording, video recording and its/their release, publication, exhibition, or reproduction to be used for news, web casts, promotional purposes, telecasts, advertising, inclusion on websites, social media, or any other purpose by The Platform and affiliates and representatives. By entering the event premises, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, web casting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, web casting, or other publication irrespective of whether a fee for admission or sponsorship is charged.

The Platform shall not be responsible for any auto-liability or auto damage by or from the vendor. The Platform shall not be responsible for any loss or damage incurred by Vendor, including, without limitation, damage to Vendor’s property, loss of sales, or injury to or death of Vendor (or its agents, employees, and/or personnel). The Platform’s  maximum liability arising out of or relating to this Agreement shall not exceed, in the aggregate, the amounts paid to it by Vendor, and in no event shall The Platform be liable for any consequential, incidental, indirect, punitive or special damages regardless of the cause of such damages. Vendor expressly assumes all risks of loss, damage, liability, injury, or destruction resulting from any cause whatsoever, including but not limited to acts or omissions by Vendor, and hereby releases and waives any claims against The Platform related to such loss, damage, liability, injury, and/or destruction. Vendor covenants that it shall be fully responsible for any damages resulting from its participation in any Event, and agrees to indemnify, defend, and hold The Platform (and its officers, employees, agents, vendors, affiliates, and representatives) harmless against any claims arising out of or related to Vendor’s participation in any Event, including for claims arising out of Vendor’s negligent actions or omissions.

By selecting the “I agree” button, I am signing this document electronically. I agree that my electronic signature is the legal equivalent of my manual/handwritten signature on this document. By selecting “I agree” using any device, means, or action, I consent to the legally binding terms and conditions of this document. I further agree that my signature on this document is as valid as if I signed the document in writing. I am also confirming that I am authorized to enter into this Agreement. If I am signing this document on behalf of a minor, I represent and warrant that I am the minor’s parent or legal guardian.
